Short answer

During his 2021 run for governor, Kevin held fundraising livestreams in which he analyzed stocks in exchange for campaign donations. In 2023 the California Department of Financial Protection and Innovation alleged that between May 30 and June 26, 2021 this was unlicensed investment-adviser activity. Kevin entered a consent order without admitting or denying, agreed to desist, and paid a $5,000 administrative penalty. By then he had passed the Series 65 (September 2022). His account: the fight was not worth $5,000, and he believes the referral was political. 123

The record

In 2023 the California Department of Financial Protection and Innovation alleged that from May 30 through June 26, 2021, during livestreams on his YouTube channel raising money for his gubernatorial campaign, Kevin performed investment-adviser activity without a California license. He entered a consent order without admitting or denying a violation, agreed to desist from unlicensed adviser activity, and paid a $5,000 administrative penalty. The matter is disclosed in the company’s Form 1-K and Form 1-A. 1

He passed the Series 65 in September 2022, after the conduct and before the order, and was a licensed investment adviser from then until he wound that down with the ETF in 2025. 3

The only video the state ever investigated was my 30-plus-hour livestream where I did not sleep, analyzing stocks in exchange for campaign donations, while I was rising in the polls. I believe I was targeted by Gavin Newsom. I settled for $5,000 because the fight was not worth $5,000 to me, even though I had become a licensed financial adviser by then. It reinforced my focus on compliance, and on staying out of politics. 2

His belief about who prompted the referral is his opinion. Nothing in the order says why the department opened the file.

How to weigh it

The order covers four weeks in 2021, before House Hack existed. The penalty is $5,000. It is the only regulatory penalty against Kevin on the public record. It is also the reason the company’s videos and livestreams today carry the disclaimer that Kevin is not currently a licensed financial adviser and that the content is not personalized advice.

The annual reports describe it in one paragraph: the DFPI alleged unlicensed investment adviser activity from at least May 30, 2021 through June 26, 2021, during campaign fundraising livestreams; Kevin entered a consent order without admitting or denying a violation, agreed to desist from unlicensed adviser activity, and paid a $5,000 administrative penalty. The reports add that in September 2022, before the claim, he had passed the Series 65 and become a registered investment adviser representative at his SEC-registered adviser firm. 5
