Short answer

Members receive trade alerts after he acts, which is the opposite of front-running his members; the open question is the sequence between his trades and his public videos on the same stocks, and what rules bind the three other employees. He has no adviser registration today and so is outside the SEC’s adviser code-of-ethics rules; he is bound by the general anti-fraud and anti-manipulation laws that apply to anyone. A written personal-trading and disclosure policy is the missing piece. 12

Kevin’s account

Kevin does not trade stocks; he only invests in stocks for the long term. He does trade sold puts, and very small dollar amounts on prediction markets, which, any time they are talked about, are always transparently disclosed. When we say puts, it should be clear those are bullish sold puts. Kevin does not short companies, and Kevin has never been sponsored to date by a company that wanted its stock promoted. 3

He says he does not trade stocks at all, only invests for the long term, sells bullish puts, and discloses the small prediction-market bets. His account, and consistent with the alert archive members see. 1
